These Terms of Service ("Terms") govern your access to and use of the Kachd platform ("the Platform"), including the website at kachd.com, the Kachd desktop application, and all related services. The Platform is operated by NorfBay LLC ("NorfBay," "we," "us"); Kachd is a trade name and product brand of NorfBay LLC. By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

Kachd is a privacy-first community platform for hosting and sharing digital content. The Platform provides:

4.1 Your content
You retain all rights to content you upload, post, or share on the Platform. By uploading content, you grant Kachd a non-exclusive, worldwide, royalty-free license to store, process, transmit, and display your content solely as necessary to operate and provide the Platform. This license ends when you or we delete the content, except for copies in short-term backups.
4.2 Responsibility for content
You represent and warrant that you own or have the necessary rights to all content you upload, and that your content does not violate any third party's rights. You are solely responsible for the content you share.
4.3 Content deduplication
The Platform uses SHA-256 hashing for content-addressed storage. If you upload a file identical to one already on the Platform, both uploads will reference the same storage object. Deleting your copy removes your reference; the underlying data is deleted only when no references remain.
5.1 Community owners
Community owners are responsible for moderating their communities. They may appoint moderators, set channel permissions, configure AutoMod rules, enable slow mode, and manage member roles. Community owners must ensure their communities comply with these Terms.
5.2 NSFW content
Content that is sexual, violent, or otherwise not suitable for all audiences must be posted only in channels explicitly marked as NSFW by the community owner. NSFW channels are gated behind a confirmation dialog.

The following content is prohibited everywhere on the Platform, including NSFW channels:
6.1 Platform subscriptions
Kachd offers optional subscription tiers (Creator, Pro, Vault) that unlock additional storage, file size limits, and features. Subscriptions are billed monthly through Stripe and renew automatically until cancelled.
6.2 Marketplace transactions
All users, including those on the Free tier, can sell digital files, products (albums/bundles), and paid community access. Payments are processed through Stripe Connect. The Platform retains a tiered service fee on all marketplace transactions: 20% for sellers on the Free plan, or 15% for sellers with an active paid subscription (Creator, Pro, or Vault). This applies to individual file sales, product/album sales, pay-what-you-want transactions, paid community subscriptions, and community tier subscriptions. The remaining 80–85% is paid out to sellers directly via their connected Stripe account. Stripe's own processing fees (typically 2.9% + $0.30 per transaction) are deducted separately by Stripe before payout.
6.3 Community tiers
Community owners may create paid subscription tiers to gate access to specific channels within their community. Tier subscriptions are billed monthly through Stripe. The same tiered service fee (20% free / 15% paid) applies to all tier subscription revenue. Higher-priced tiers automatically include access to channels gated by lower-priced tiers. Community owners and admins bypass all tier gating within their own communities.
6.4 Pay-what-you-want pricing
Sellers may enable pay-what-you-want pricing with an optional minimum. Buyers choose the amount they pay at or above the minimum. The applicable platform fee (20% or 15% depending on the seller's subscription tier) applies to the actual amount paid by the buyer.
6.5 Refunds
Refund policies for marketplace transactions are set by each seller. If a seller does not specify a policy, purchases are final. The Platform reserves the right to issue refunds in cases of fraud, policy violation, or technical error. Subscription refunds are handled on a case-by-case basis; contact support@kachd.com.
6.6 Tax responsibility
Sellers are responsible for reporting and paying any applicable taxes on their earnings. Kachd does not provide tax advice or withholding services.
We respect intellectual property rights and respond to valid DMCA takedown notices. For details on filing or responding to a takedown, see our DMCA Policy.
Accounts that are the subject of repeated valid DMCA takedown notices may be terminated under our repeat infringer policy.
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
9.1 By us
We may suspend or terminate your account, remove content, or restrict access at our sole discretion if we reasonably believe you have violated these Terms, applicable law, or pose a risk to other users or the Platform. Where possible, we will notify you and provide an opportunity to appeal.
9.2 By you
You may delete your account at any time by contacting support@kachd.com. Active subscriptions should be cancelled before account deletion to avoid further charges.
9.3 Effect of termination
Upon termination, your right to use the Platform ceases immediately. Content you uploaded may persist if it is referenced by other users (due to deduplication), but your association with it will be removed.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not endorse or guarantee the accuracy, completeness, or reliability of any user-generated content.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NORFBAY LLC (OPERATOR OF KACHD) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
You agree to indemnify and hold harmless NorfBay LLC (operator of Kachd) from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Platform, your content, or your violation of these Terms.
Any disputes arising from these Terms or your use of the Platform will be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive relief in any court of competent jurisdiction. You agree to resolve disputes on an individual basis and waive any right to participate in a class action.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
We may update these Terms at any time. When we make material changes, we will update the effective date and, where appropriate, notify you via the Platform or email. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
