DMCA & Copyright Policy

Kachd ("the Platform") is operated by NorfBay LLC ("NorfBay," "we," "us"). NorfBay LLC respects the intellectual property rights of others and expects its users to do the same. We respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.

1. Designated Agent

2. Filing a Takedown Notice
If you believe that content hosted on the Platform infringes your copyright, you may submit a written takedown notice containing all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notice, a representative list of such works.
- Identification of the material that is claimed to be infringing, and information reasonably sufficient to permit us to locate the material on the Platform (e.g., URL, filename, community name, channel name, or SHA-256 hash).
- Your contact information: full legal name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Notices that do not substantially comply with these requirements may not receive a response. We may request additional information before processing incomplete notices.
3. How We Process Takedown Notices
Upon receiving a valid takedown notice, we will:
- Promptly remove or disable access to the allegedly infringing material.
- Notify the user who uploaded the material that it has been removed or disabled, and provide them with a copy of the notice (with the complainant's personal contact information redacted where appropriate).
- Record the notice in our internal DMCA log for repeat-infringer tracking.
4. Counter-Notification
If you believe your content was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification containing all of the following:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled, and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your full legal name, mailing address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Kachd may be found), and that you will accept service of process from the person who provided the original takedown notice or an agent of such person.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not notify us within 10 business days that they have filed a court action seeking to restrain the allegedly infringing activity, we will restore the removed material.
5. Repeat Infringer Policy
In accordance with the DMCA, we maintain a policy for the termination of accounts of users who are repeat infringers:
- First offense: The infringing content is removed and the user receives a written warning.
- Second offense: The infringing content is removed and the user's upload privileges may be suspended.
- Third offense: The user's account may be permanently terminated.
We consider the totality of the circumstances when determining appropriate action, including the nature and scope of the infringement and whether the user has filed valid counter-notifications.
6. User Reporting
In addition to formal DMCA notices, users can report potentially infringing content directly through the Platform using the Report button available on any file or message. Reports are reviewed by our moderation team and may result in content removal if a violation is confirmed.
7. Content-Addressed Storage and Takedowns
The Platform uses SHA-256 content-addressed storage with deduplication. When multiple users upload identical files, they share a single storage object. A DMCA takedown applies to the specific file reference identified in the notice. If the underlying storage object is referenced by other users who uploaded the same content independently, those references are not automatically removed. Separate notices are required for each instance of alleged infringement.
8. Content Scanning
Uploaded files are checked for MIME type validity and known malware signatures. We may implement additional content identification measures in the future to proactively detect infringing material.
9. Good Faith and Misuse
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be liable for damages. Do not file a takedown notice or counter-notification unless you have a good faith belief that the claim is valid.
We reserve the right to suspend or terminate the accounts of users who abuse the DMCA process, including filing repeated false or fraudulent notices.
10. Limitation
This policy addresses copyright infringement claims only. For other intellectual property concerns (trademarks, trade secrets), or for general content policy violations, please contact legal@kachd.com.
11. Changes to This Policy
We may update this DMCA Policy from time to time. When we make material changes, we will update the effective date at the top. Your continued use of the Platform after changes take effect constitutes acceptance of the updated policy.
